Da Vinci Robot Lawsuits: Bernstein Liebhard LLP Comments on Colorado Investigation of Surgeon Accused of da Vinci Surgery Complications

New York, New York (PRWEB) April 18, 2013

As da Vinci robot lawsuits move forward in courts throughout the country, Bernstein Liebhard LLP notes that Colorado regulators are investigating a Denver surgeon who allegedly mismanaged kidney transplants performed via the da Vinci Surgical System. According to a report from CBS Denver, some of the patients the doctor operated on suffered nerve damage and internal bleeding, while at least one patient was taken off life support after sustaining a torn aorta.*

Some of the injuries detailed in the CBS report echo the types of da Vinci surgical complications allegedly suffered by our own clients. The news of the Colorado investigation just serves as a reminder that many questions remain regarding the risks and benefits of robotic surgery, says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is currently evaluating da Vinci robot lawsuits on behalf of individuals who allegedly suffered serious complications in minimally-invasive procedures involving the da Vinci Surgical System.

Da Vinci Surgery Complications

According to the CBS Denver report, the news of the Colorado investigation comes as the U.S. Food & Drug Administration has focused new attention on the da Vinci robot, amid rising reports of da Vinci surgery complications. Those complications include nicked blood vessels and perforated organs, as well as five fatality reports since January 2012.

Court documents indicate that at least a dozen da Vinci robot lawsuits are pending throughout the country on behalf of alleged victims of bad robot surgery. Earlier this week, the nations first trial involving da Vinci surgical complications opened in Washington state court. The lawsuit, which was filed by the family of a man who allegedly died as a result of complications he suffered in a da Vinci prostatectomy, alleges Intuitive Surgical watered-down its training program for the da Vinci Surgical System in order to induce more hospitals to purchase the expensive machines, Bloomberg.com reported.** (Estate of Fred E. Taylor v. Intuitive Surgical Inc., 09-2-03136-5, Superior Court, State of Washington, Kitsap County)

According to a notice entered in the U.S. District Court, Eastern District of Louisiana on March 14th, Intuitive Surgical has already agreed to settle one claim filed by a woman who allegedly suffered serious complications during a thyroid procedure. (Silvestrini v. Intuitive Surgical Systems Inc., No. 11-2704 (E.D. La.) On February 19th, Intuitive filed a petition with the U .S. District Court, Northern District of California seeking coordination of 11 da Vinci robot lawsuits before a single judge. (Cook v. Intuitive Surgical Inc., No. 12-6363 (N.D. Calif.))

Alleged victims of bad robot surgery associated with the da Vinci Surgical System may be entitled to compensation for medical expenses, lost wages, pain and suffering, and more.
