Mirena IUD lawsuit (http://www.mirenalawsuit2014.com/) filings continue to mount, as the number of cases pending in two consolidated state and federal litigations have now surpassed 2,500 filings, Bernstein Liebhard LLP reports. According to an updated Docket Report issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on January 15, 2014, at least 1,160 claims have been filed in the federal multidistrict litigation currently underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434) Court documents indicate that an additional 1,375 Mirena lawsuits have been filed in the multicounty litigation established in New Jerseys Bergen County Superior Court, where Bernstein Liebhard LLP is actively filing claims. According to court documents, all of the Mirena lawsuits pending in Bergen County Superior Court, as well as those in the Southern District of New York, similarly allege that spontaneous migration of the contraceptive device caused plaintiffs to suffer uterine perforations, ectopic pregnancies, organ damage, infertility and other serious complications. Plaintiffs further allege that Bayer HealthCare Pharmaceuticals failed to warn that the IUD could become dislodged from its proper position in the uterus and migrate to other areas of the body, even after it was correctly inserted by a healthcare provider. The claims point out that the current labeling for Mirena only cautions that IUD migration may occur if the uterus is perforated upon insertion.
The Mirena IUD is a long-acting contraceptive device that was initially approved by the U.S. Food and Drug Administration (FDA) in 2000. In 2009, its approved indications were expanded to include the treatment of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control.* That same year, the FDA issued a Warning Letter to Bayer after it determined that some of the companys marketing claims regarding the safety and effectiveness of the Mirena IUD were misleading.
